Kyptik Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kyptik application, website, and related services (collectively, the "Service"), provided by Kyptik.com (referred to as "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.

The Service is intended for users who are at least 18 years old or the age of majority in their jurisdiction. If you are under this age, you may not use the Service.

1. Service Description & Acceptance

Kyptik provides a comprehensive suite of AI-powered tools, community features, and support programs. By using any feature of the Service, you acknowledge and agree to these Terms in full. We may update these Terms at any time; continued use constitutes acceptance of changes.

⚠️ BETA Notice: This platform is currently in BETA and under active development. Features, functionality, pricing, and these Terms may change without prior notice.

2. User Accounts

• You must create an account to access premium features and certain services.
• You are responsible for maintaining account security and all activities under your account.
• You must provide accurate, complete information when required.
• We may suspend or terminate accounts that violate these Terms or for any reason, without liability.

3. Subscriptions & Payments

• Premium Subscription: $5/month, billed monthly. Auto-renewing via Stripe or PayPal.
• Affiliate (Worker) Access: Completely free with no upfront costs to complete tasks and earn commissions.
• Marketplace: Listing is free for premium members. We collect a 5% platform fee on completed sales.
• Cancellation: Cancel your subscription anytime. No refunds for partial billing periods.
• Taxes: You are responsible for all applicable taxes in your jurisdiction.
• Changes: We reserve the right to change pricing with advance notice to active subscribers.

4. Premium Tools & Features

Premium subscription grants access to the following tools. All outputs are provided "as is" for informational and entertainment purposes only and do not constitute professional advice of any kind.

User Responsibility: You are responsible for reviewing and ensuring the accuracy, legality, and appropriateness of all AI-generated content before use. We are not liable for copyright infringement, defamation, or misuse of generated content. Generated avatars, GIFs, and images must not be used to impersonate, harass, or deceive others.

5. VIP Supporter Program

The VIP Program is a supporter program. You can apply for approval or get instant access by making a deposit.

5.1 What VIP Offers

VIP is a way to support Kyptik's growth and development. In return, VIP members receive:

• Premium Access: Up to 1 year of free Premium membership, unlocking all 25+ premium tools.
• Early Access & Test Groups: Exclusive access to tools, features, and products that are not public yet — including Traders Lounge test groups helping us build a powerful automation tool. You can run things during test phases and provide valuable feedback that shapes the final product.
• VIP Badge & Status: An exclusive badge on Discord and your Kyptik profile, plus access to a private VIP Discord channel.
• Giveaways & Bonuses: Automatic entry into giveaway cycles, prize draws, and surprise perks at Kyptik's sole discretion.
• Cash Payouts & Rewards: Eligibility for loyalty bonuses and cash payouts as a thank-you for your support.
• Priority Support: Direct access to the team and priority handling of requests.

5.2 Nature of Deposits & Non-Refundability

• Purpose: VIP deposits are voluntary financial contributions that help support Kyptik's growth and operations. They are contributions — not investments, loans, purchases of securities, or payment for any guaranteed service.
• Non-Refundable: All deposits, payments, and amounts placed into the VIP program are strictly non-refundable. By depositing, you acknowledge and accept this condition in full. No refunds will be issued under any circumstances, including account closure, loss of VIP status, change of mind, or service changes.
• Deductions From Balance: Any costs, subscription fees, or charges you authorise within Kyptik (including Premium subscription renewal, Traders Lounge access, or marketplace purchases) may be deducted from your VIP balance at our discretion. These deductions are also non-refundable once processed.
• Giveaways & Bonuses: Upon depositing, you may be listed for giveaways and bonus distributions at Kyptik's sole discretion. Participation does not guarantee any specific reward, payout, or return. Giveaway outcomes, amounts, and timing are determined solely by Kyptik.
• No Guaranteed Returns: VIP is a support program, not an investment product. We make no guarantee of any payout, bonus, profit, or financial return of any kind.
• Withdrawal of Earned Bonuses: Only bonuses or payouts credited to your VIP account by Kyptik (not your deposits) may be withdrawn via supported payment methods. Withdrawals are subject to admin review and approval.
• Termination: We reserve the right to revoke VIP status at any time, for any reason, without notice or compensation. No refund of any deposit is owed upon termination.
• Compliance: You agree that your participation complies with all laws in your jurisdiction. It is your sole responsibility to ensure that participating in the VIP program is legal where you reside.

⚠️ By depositing to the VIP program, you confirm you understand that all amounts are non-refundable voluntary contributions to support Kyptik, that costs and subscriptions may be deducted from your balance, and that any rewards are provided at Kyptik's sole discretion with no guarantee of any return.

6. Traders Lounge

Traders Lounge is a separately accessed exclusive trading community providing automation tools, analysis helpers, and trading bots.

• Access is granted after payment and admin verification.
• Content and tools within Traders Lounge are for educational, informational, and community discussion purposes only.
• Nothing shared or provided within Traders Lounge constitutes financial, investment, or trading advice.
• Automation Tools: All automation tools, bots, signals, copiers, and helpers are provided to be helpful only. They cannot guarantee any outcome, profit, or result. They may malfunction, produce incorrect signals, or fail to execute as intended.
• Your Responsibility: You are solely responsible for every trade placed in your account, whether manual or automated. You must monitor your positions and never rely on any tool without oversight.
• Risk Warning: Trading involves substantial risk of loss. Only trade with capital you can afford to lose entirely. Always do your own research and seek independent professional advice before trading. We are not financial advisors.
• Your Funds: Your funds remain entirely in your own account. We never hold, manage, or have access to your trading capital.
• Beta / Development: Some Traders Lounge features are under development and testing and may be available only to VIP test groups. Using pre-release features carries additional risk.
• Access may be revoked for violations of these Terms or community rules without refund.
• Payments for Traders Lounge access are non-refundable.

⚠️ By accessing Traders Lounge, you confirm you understand that the automation tools cannot guarantee any outcome, that you trade entirely at your own risk, and that Kyptik is not liable for any trading losses or account damage.

7. Marketplace

Premium members may list digital products or services on our marketplace platform:

• Listing Requirements: All listings must be approved before going live and must comply with our Marketplace Guidelines.
• Platform Fee: 5% commission on all completed sales.
• Payment Processing: All payments processed securely through Stripe.
• Seller Obligations: Sellers must deliver as described and handle disputes professionally.
• Content Standards: No illegal, fraudulent, adult, or harmful content. No copyright infringement.
• Termination: We may remove listings or suspend access for violations without refund.

8. Referral & Affiliate Program

• Premium Members: Earn 45% recurring commission on referred users' monthly payments while both accounts remain active.
• Non-Premium Members: Earn 45% one-time commission on the first payment from referred users.
• Payment: Commissions added to your wallet. Withdraw via PayPal, bank transfer, crypto, or gift cards (minimum $10).
• Fraud Prevention: Self-referrals and fraudulent referrals are prohibited and may result in termination and forfeiture of all earnings.
• Tax Obligations: You are solely responsible for reporting and paying taxes on all earnings.
• No Employment: Affiliates are independent contractors, not employees of Kyptik.
• Changes: Commission rates and program terms may change with advance notice.

9. Worker Program (Micro-Tasks)

• Free Access: No subscription required to participate.
• Task Availability: Tasks are not guaranteed and are posted based on business needs.
• Quality Requirements: Submissions must pass admin review to qualify for payment.
• Payment Processing: Wallet balance withdrawable via PayPal, bank transfer, crypto, or gift cards (minimum $10).
• Tax Obligations: You are solely responsible for taxes on all income earned.
• No Employment Relationship: Workers are independent contractors, not employees.
• Abuse Prevention: Fraudulent submissions may result in account suspension.

10. User Conduct & Prohibited Activities

You agree not to:

• Use the Service for illegal, fraudulent, or harmful purposes
• Harass, abuse, threaten, or harm other users
• Post false, misleading, or defamatory content
• Infringe copyrights, trademarks, or intellectual property rights
• Attempt to hack, disrupt, or reverse-engineer the Service
• Create fake accounts or manipulate platform features
• Use advisor or intuitive reading services to make consequential life decisions
• Scrape, mine, or extract data without permission
• Resell or redistribute Service access or content
• Upload malware, viruses, or malicious code
• Spam, advertise, or solicit users without permission
• Impersonate other users, advisors, or Kyptik staff

Violations may result in immediate account termination without refund.

11. User Content & License

By submitting content (inputs, uploads, forum posts, listings, etc.), you:

• Retain ownership of your content
• Grant us a worldwide, royalty-free license to use, display, and process your content to provide and improve the Service
• Represent that you have all necessary rights to submit the content
• Acknowledge that AI-generated outputs may not be protectable by copyright

We may remove any content that violates these Terms without notice.

12. Intellectual Property

The Service, including all software, designs, text, graphics, and trademarks, is owned by Kyptik or our licensors. You receive a limited, non-exclusive, non-transferable license for personal use only.

✓ Your Content Ownership: You retain full ownership of content you create using Kyptik tools (text, images, designs, GIFs, avatars, etc.). Kyptik does not claim ownership of your creations. You may use, modify, distribute, and monetize them freely.

13. Data & Privacy

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to data collection and use as described therein, including for AI training and service improvement.

14. Disclaimers & Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We make no guarantees regarding:

• Service availability, uptime, or error-free operation
• Accuracy, completeness, or reliability of any AI outputs
• Financial results from any tools, trading signals, or strategies
• Health or wellness outcomes from any tools
• Accuracy or outcomes of intuitive readings or advisor sessions
• Success of marketplace listings, referral earnings, or affiliate commissions
• Any payout, reward, or return from the VIP program
• Task availability or payment amounts in the worker program

LIMITATION OF LIABILITY: To the maximum extent permitted by law, our total liability is limited to the amount you paid us in the last 12 months (or $100 if greater). We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data loss, or business interruption.

15. Indemnification

You agree to indemnify and hold harmless Kyptik, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of third-party rights.

16. Termination

We may suspend or terminate your access immediately for any reason, with or without notice. Upon termination, your license to use the Service ends immediately. All provisions regarding liability, indemnification, and dispute resolution survive termination.

17. Dispute Resolution

Any disputes arising from these Terms shall be resolved individually (no class actions) through good faith negotiation. If unresolved, disputes shall be handled in accordance with the laws of England and Wales. Each party bears its own costs.

18. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any unresolved disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

19. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance.

20. Entire Agreement

These Terms, together with our Privacy Policy and Marketplace Guidelines, constitute the entire agreement between you and Kyptik regarding the Service, superseding all prior agreements.
